The law

Since 2 August 2026, AI
has its own rules.

The European AI Regulation is now fully applicable, and Italy has implemented it through Law 132/2025 and the first implementing decrees. For companies using AI tools, including ChatGPT, Copilot and Gemini, three concrete obligations apply.

  • Mapping and governance. Article 26 of Reg. EU 2024/1689 requires deployers of high-risk AI systems to keep usage records, assess risks and ensure human oversight.
  • Mandatory AI literacy. Article 4 of the Regulation requires anyone using AI systems to ensure an «adequate level of AI literacy» among the staff involved.
  • Transparency, since 2 August 2026. Article 50 requires disclosure when content — image, video or text — is generated by AI, and identification of automated systems that interact with people. Failing to do so carries fines of up to 15 million euro or 3% of global turnover.
